			<content:encoded><![CDATA[<p>Two people killed Sunday when their motorcycle collided with a pickup truck in Port Orange were identified today an Apopka husband and wife.</p>
<p>Police said the driver of the truck had been drinking and faces multiple charges, including driving under the influence of alcohol and two counts of DUI manslaughter.</p>
<p>Randall A., 40, and Laura A., 44, were killed in the crash, which occurred about 5:50 p.m. in the 1600 block of Taylor Road, Port Orange police Assistant Chief Wayne M. Miller said.</p>
<p>The motorcycle was westbound on Taylor Road when an eastbound truck driven by Al H., 54, of Port Orange, attempted to make a left turn into a shopping plaza and drove directly into the path of the motorcycle, Miller said. Both of the victims were thrown from the motorcycle and died at the scene, he said. Investigators have not determined who was driving the motorcycle.</p>
<p>Al, who suffered minor injuries in the crash, also faces charges of DUI involving property damage, resisting arrest without violence, refusing to submit to a breath test and refusing to accept and sign traffic citations, Miller said. </p>

			<content:encoded><![CDATA[<p>Former Major League pitcher Curtis John Leskanic faces charges of driving under the influence and child neglect without harm following his arrest this week in Altamonte Springs.</p>
<p>Leskanic, 44, who lives on Alaqua Drive in west Seminole County, had a blood-alcohol level of .331, more than four times the legal limit of .08, according to an arrest affidavit. The level was so high that he had to be checked out at a hospital before being booked into the Seminole County Jail.</p>
<p>He was found passed out at the wheel of his pickup truck on State Road 436 at Ronald Regan Boulevard with his 5-year-old daughter asleep, and unrestrained, in the truck, according to the report. Police said the child was given to a family member.</p>
<p>In 11 seasons with Colorado, Milwaukee, Kansas City and Boston, Leskanic had a 50-34 won-loss record. His final season was 2004, when he pitched for the World Series champion Red Sox.</p>
<p>According to the arrest report:</p>
<p>Police received a call about 7:30 p.m. Monday about a pickup truck &#8220;swerving all over the road&#8221; with information that the driver&#8217;s daughter was in the vehicle.</p>
<p>As an officer drove east on State Road 434 toward Ronald Regan Boulevard, he noticed a truck stopped in the roadway, even through the traffic light at the intersection was green.</p>
<p>It took two attempts to awaken Leskanic, who was &#8220;hunched over as if he was sleeping.&#8221;</p>
<p>The first time the officer asked Leskanic for his drivers license, the man handed over his scout identification card from Major League Baseball.</p>
<p>Leskanic failed a series of roadside sobriety tests.</p>
<p>Once he was placed under arrest he became agitated and started screaming.</p>
<p>In DUI cases, two blood-alcohol tests are normally performed, but Leskanic refused to take a second test.</p>

			<content:encoded><![CDATA[<p>A 19-year-old Satellite Beach woman was hospitalized early this morning after trying to flee from local deputies and eventually crashing in Orange County, officials said.</p>
<p>The Brevard County Sheriff’s Office said Amber W. had struck a pedestrian in Cape Canaveral, then left the scene. Deputies spotted her 1997 Saturn coupe on westbound State Road 528 near Banana River Drive.</p>
<p>Twice between that point and U.S. 1, deputies set out spikes on the Beachline, trying to disable the vehicle. A helicopter began following the car.</p>
<p>“They spotted the vehicle with a DUI-type driving pattern,” said Lt. Alex Herrera, a sheriff’s spokesman. “They were able to successfully deploy the stingers twice, but she kept going.”</p>
<p>Florida Highway Patrol troopers took over the chase as the car reached State Road 520. When the Saturn took the exit toward International Corporate Parkway about 2:50 a.m., the FHP said Amber failed to negotiate the curve. Her coupe went off the road, spun sideways and flipped.</p>
<p>Firefighters extricated Amber from the car and took her to Orlando Regional Medical Center. She suffered serious injuries in the wreck.</p>
<p>Amber has several misdemeanor and felony arrests, mainly relating to theft and the consumption of alcohol by a minor. The FHP said charges in Wednesday morning’s incidents will depend on the results of blood testing.</p>
<p>Amber had a suspended learner’s permit.</p>

<p>The Lake County Sheriff&#8217;s Office reports that 47-year-old Nickolas W. died Tuesday.</p>
<p>Authorities say Sorrento was booked into the jail Tuesday morning on charges of driving with a suspended license from a previous DUI. Officials say Nickolas received a medical screening but didn&#8217;t indicate any health issues.</p>
<p>Later that day, nurses tried to revive Nickolas, who appeared to be having a seizure.</p>
<p>The Orlando Sentinel ( http://thesent.nl/q9Tbzn) reports that Nickolas was taken to a nearby hospital, where he died.</p>
<p>An autopsy revealed no signs of trauma. Officials say they&#8217;re awaiting toxicology results to determine the cause of death.</p>

			<content:encoded><![CDATA[<p>Injuries manifesting themselves weeks after traffic crashes are historically common, but they have been especially prevalent in 2011, a year in which 49 deadly wrecks have been reported in Brevard County as of Friday. Of the 33 investigated by the Florida Highway Patrol, 10 of them were labeled &#8220;delayed fatalities.&#8221; Only seven such accidents occurred in all of 2010.</p>
<p>The phenomenon often dogs police agencies, which do not extensively investigate crashes in which the injuries initially are not considered severe.</p>
<p>After minor crashes, Florida law prevents them from requiring an at-fault driver to submit to toxicology testing, according to interviews with West Melbourne police, the Florida Highway Patrol and the Brevard-Seminole State Attorney&#8217;s Office. Only when injuries are serious can law enforcement forcibly draw blood from the driver, police and prosecutors said.</p>
<p>And if the motorist already has been ticketed, in most cases, the authorities said double-jeopardy rules prevent police from filing criminal charges if a victim dies weeks later.</p>
<p>This trend could easily change the way police are required to investigate crashes that seem minor. However, anyone charged with <a href="http://www.orlandoduiattorneys.com/">DUI in Orlando</a> will still be able to challenge the acquisitions against. No chemical test is perfect.</p>

			<content:encoded><![CDATA[<p>Prosecutors and defense lawyers for Lake County civic leader Bruce D. must submit sentencing recommendations to a judge by Sept. 6, suggesting an appropriate punishment in his DUI/manslaughter case.</p>
<p>Bruce, accused of driving drunk Oct. 17, 2009, when he crashed his Nissan Titan pickup into a motorcycle, killing the rider, turned himself into the Lake County Jail on Monday, choosing to live behind bars until Circuit Judge Michael Takac decides his case.</p>
<p>It was unclear why Bruce , 48, chose jail now.</p>
<p>He faces up to 15 years in prison if found guilty but had been free on a $50,000 bond.</p>
<p>The former assistant public defender and assistant county attorney known for his civic and charitable works declined an Orlando Sentinel request this week for a jail interview, sheriff&#8217;s spokesman Sgt. Jim Vachon said.</p>
<p>Bruce could earn &#8220;credit&#8221; for each day in jail which would count toward any prison sentence he might receive.</p>
<p>His lawyers Michael Graves and John Spivey previously told the judge Bruce would plead &#8220;open&#8221; to the court, essentially admitting the facts of the case and asking for leniency in the death of the victim, 61, a Navy veteran and retired postal worker with many friends but no local family ties.</p>
<p>Assistant State Attorney Sue Purdy said prosecutors would seek a prison sentence of 9 1/2 to 15 years, the range of time recommended by state sentencing guidelines, which use a mathematical formula.</p>
<p>Graves declined comment.</p>
<p>The defense lawyers recently added Lake Mary addiction psychiatrist Alan S. Bern to a list of witnesses, who could testify at a hearing Sept. 19 to Bruce&#8217;s character, remorse and risk to reoffend.</p>
<p>Others on the list include circuit judges G. Richard Singeltary and T. Michael Johnson, a former work colleague; Charles Mojock, president of Lake-Sumter Community College; and state Rep. H. Marlene O&#8217;Toole, R-Lady Lake.</p>
<p>The judge must cite a reason if he imposes a sentence more lenient than state guidelines.</p>
<p>&#8220;Everyone has a right to make a statement in court on behalf of anyone else, if they choose to,&#8221; Purdy said when asked about the list of local luminaries. &#8220;I would hope that these citizens understand the importance of following the law and imposing consequences when the law is broken, especially people who work in Tallahassee and who have helped create those laws and consequences.&#8221;</p>
<p>Bruce had a blood-alcohol level of 0.16 percent, twice the level at which a motorist is presumed to be impaired. Troopers also found a half-empty vodka bottle in his truck.</p>

			<content:encoded><![CDATA[<p>The Florida Highway Patrol on Friday arrested a Longboat Key man on Florida&#8217;s Turnpike in Fort Pierce after finding him so incoherent &#8220;and unaware of his surroundings&#8221; that he could barely identify his 6-year old daughter, who was in the vehicle with him, according to arrest reports.</p>
<p>Ryan C., 25, of Longboat Key, faces charges of DUI and third-degree felony child neglect.</p>
<p>Ryan and his daughter were discovered inside a disabled truck that troopers said was blocking the southbound lanes of traffic.</p>
<p>Authorities found a prescription bottle of the anti-anxiety drug Larazepam inside the car, which he claimed were prescribed to him Aug. 8.</p>
<p>Ryan was transported to Lawnwood Medical Center &#038; Heart Institute for medical treatment. When troopers asked him to identify the girl in his truck, Ryan &#8220;acted as if he didn&#8217;t remember for a brief period and then stated her name&#8221; and indicated she was his daughter.</p>
<p>Ryan was transferred to the St. Lucie County jail, where he was being held Sunday night under a bond of $15,350.</p>

			<content:encoded><![CDATA[<p>The Fifth District Court of Appeal ruled Friday there should be a new trial in the wrongful death case involving a young man struck and killed in early 2006 by another driver allegedly chased by Orlando Police.</p>
<p>A jury found the City of Orlando 55 percent responsible in the death of Edwin A., 21, whose vehicle was struck on Jan. 20, 2006 by a pickup driven by Keynon C. The jury found Keynon 45 percent at fault.</p>
<p>However, City of Orlando lawyers appealed the case, making a number of legal arguments and challenges.</p>
<p>The Fifth DCA agreed with the city&#8217;s argument that the jury was prejudiced when the judge allowed the attorney representing Carmen Pineiro to argue in a closing argument that the city and OPD would be &#8220;laughing&#8221; if the dead man&#8217;s parents were not compensated.</p>
<p>&#8220;If you don&#8217;t hold the City of Orlando accountable or you don&#8217;t compensate the mother and father of Edwin in an amount equal to their harm that the City of Orlando caused, when you see the City of Orlando folks outside the courtroom…guess what they are going to be doing?&#8221; counsel asked. &#8220;They are going to be doing exactly what they were doing at the scene of the accident and at the Citrus Bowl, laughing.&#8221;</p>
<p>In the ruling, the Fifth DCA said it agreed &#8220;that these comments were highly inflammatory, without basis in evidence, not in response to the City&#8217;s closing, and were intended to do nothing but prejudice the jury.&#8221;</p>
<p>The appeals court said the argument was a &#8220;calculated effort&#8221; to engender an emotional response by the jury and that &#8220;in order to avoid being laughed at, post-verdict, it must find the city liable.&#8221;</p>
<p>&#8220;This argument was clearly improper,&#8221; the court said in the 17-page ruling.</p>
<p>The DCA also found the &#8220;cumulative effect&#8221; of other &#8220;objected-to improper comments…acted in concert to deprive the city of a fair trial.&#8221;</p>
<p>&#8220;Such comments cannot be condoned, and we urge vigilant adherence, on retrial, to professional standards during closing argument,&#8221; the court said in its opinion filed Friday.</p>
<p>Circuit Judge Julie O&#8217;Kane entered the final judgment in the case, but did not preside over the trial or deny the city&#8217;s motion for a new trial.</p>
<p>The total jury award was $1,278,975, according to the city attorney&#8217;s office, and the city&#8217;s portion was $730,207.93, including funeral costs. However, a special legislative claims bill would have been needed to collect that amount because the statutory cap for awards against the city is $200,000.</p>
<p>The crash created controversy in 2006 when witnesses accused police of chasing Keynon at a high speed. An internal report later cleared the officers involved.</p>
<p>Keynon pleaded guilty and was convicted of DUI manslaughter in Edwin&#8217;s death. He was sentenced to five years in prison, and Department of Corrections records show he is supposed to be released in September 2012.</p>

			<content:encoded><![CDATA[<p>An Orlando driver with a violent criminal past sped away from FHP troopers Wednesday morning on State Road 408 and rammed a stolen car into the back of one of their patrol cars, officials said.</p>
<p>After using their Taser to stop 27-year-old Alexis G. from running away from them, rescue crews took him to Florida Hospital East because he complained of injuries.</p>
<p>FHP spokeswoman Sgt. Kim Montes said Alexis was under the influence of drugs during the incident.</p>
<p>&#8220;He admitted to taking drugs, but refused the [blood and urine] tests,&#8221; Montes said.</p>
<p>Alexis faces charges of aggravated battery on a law-enforcement officer, felony fleeing and eluding, possession of a stolen vehicle, driving on a revoked license, DUI, and reckless driving. </p>
<p>Once doctors clear him from the hospital, Alexis will be booked at the Orange County Jail.</p>
<p>Montes said troopers spotted Alexis driving a beige 1994 Honda eastbound on S.R. 408 around 4:40 a.m. Wednesday.</p>
<p>Troopers tried to stop him, but Alexis sped away from them and pulled off the roadway at the Goldenrod Road exit, the report shows.</p>
<p>Officials followed him onto Lake Underhill Road where he continued to drive recklessly against traffic. When the trooper passed the vehicle driven by Alexis, he slammed the front of the car twice against the rear of the trooper&#8217;s cruiser.</p>
<p>As they approached Econlockhatchee Road, the trooper then slowly bumped the left rear fender of the suspect&#8217;s car with his vehicle, causing Alexis&#8217; car to spin out of control and stop. Montes said it&#8217;s a specialized maneuver designed to disable a suspect&#8217;s vehicle with the least amount of damage to the driver.</p>
<p>When the suspect&#8217;s car stopped, he tried to run away, but troopers stopped him with their Tasers.</p>
<p>Corrections records show that Alexis has a lengthy criminal past dating back to 2001.</p>
<p>He has been booked on charges of domestic violence, grand theft, carrying a concealed weapon, battery, and aggravated battery with a motor vehicle. He also has several drug charges on his record.</p>

			<content:encoded><![CDATA[<p>Another Orange County firefighter was caught behaving badly on camera when he was pulled over for suspected DUI earlier this month, according to police.</p>
<p>Matthew H. has since been fired, WFTV learned, and that wasn&#8217;t his only questionable behavior as a firefighter.</p>
<p>Earlier this month Mathew took a field sobriety test in Daytona Beach Shores. He was off duty at the time and has not been convicted for the DUI, but the fire department said it decided to fire him for this charge and for some of his other actions in the past.</p>
<p>A video showed how he was unable to walk a straight line.</p>
<p>According to the police report, his breath test showed he was double the legal limit.</p>
<p>Officers said he smelled of alcohol and was unable to perform several tasks, including reciting the alphabet.</p>
<p>&#8220;Are you finished?&#8221; asked an officer.</p>
<p>&#8220;Honestly, sir? I can&#8217;t do it,&#8221; said Mathew.</p>
<p>Mathew told his supervisors he had driven to Daytona Beach Shores to check out a wedding location for his upcoming marriage. He had a few drinks, couldn&#8217;t get a room at the hotel, so he left the hotel.</p>
<p>Officers said they saw Mathew pull into a parking lot driveway, which was marked with a do not enter sign. It was a lot behind the Police Department. He told officers he was trying to find a place to sleep it off.</p>
<p>&#8220;I regret that I didn&#8217;t try and find alternate transportation. You know, if I could go back and do it again, I would have absolutely not have driven,&#8221; said Mathew.</p>
<p>WFTV obtained documents about Mathew&#8217;s disciplinary history. Last year, he got in trouble for failing to complete patient care reports, repeatedly failing to complete controlled substance logs, and he had a problem with tardiness.</p>
<p>He also lost a radio and never reimbursed the county.</p>
<p>Mathew was a firefighter with the department for almost three years. He made $44,000 a year and is in the process of filing an appeal.</p>
